Terms of Service

§ 1. General provisions

  1. These Terms of Service set out the rules for using the website dedicated to the publication "First Steps in Practical IFR" (the "Website") and the rules for the provision of electronic services by the Provider.
  2. The Terms have been prepared on the basis of the Polish Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws 2002 No. 144 item 1204, as amended), the Polish Civil Code of 23 April 1964 (Journal of Laws 2024 item 1061), the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws 2024 item 1796), the Polish Copyright and Related Rights Act of 4 February 1994 (Journal of Laws 2024 item 1254) and the GDPR.
  3. Use of the Website constitutes acceptance of these Terms.

§ 2. Definitions

  • Provider — Maciej Peikert, author of the publication "First Steps in Practical IFR"; contact: peikert@vp.pl.
  • User — any natural person, legal person or organisational unit without legal personality using the Website.
  • Consumer — a User who is a natural person performing a legal act with the Provider not directly related to their economic or professional activity (Article 221 of the Polish Civil Code).
  • Website — the Provider's website, including the Companion quizzes module.
  • Quizzes — interactive educational tests available after entering the access code provided with the book.
  • Book — the publication "First Steps in Practical IFR" by Maciej Peikert.

§ 3. Type and scope of services

  1. The Provider provides the following services electronically, free of charge:
    • access to information about the Book and its authors;
    • access to educational quizzes after entering a valid access code;
    • handling email correspondence with Users.
  2. Sale of the Book is not subject to these Terms and is carried out via an independent external shop linked from the Website. The terms of sale, delivery and complaints are set out in the terms of service of that shop's operator.

§ 4. Technical requirements

To use the Website you need:

  • a device with Internet access;
  • a current web browser (Chrome, Firefox, Safari, Edge) with JavaScript and localStorage support enabled;
  • an active Internet connection.

§ 5. Rules for using the Quizzes

  1. Access to the Quizzes requires entering an individual access code delivered together with the Book.
  2. The access code is intended for the User's personal use. It must not be shared, sold or made available to third parties.
  3. If unauthorised distribution of the code is detected, the Provider reserves the right to invalidate it.
  4. The Quizzes are provided strictly for educational and supplementary purposes. They do not replace official aviation training or examinations conducted by competent authorities (including the Polish Civil Aviation Authority and EASA). Quiz results do not constitute a document confirming aviation qualifications.

§ 6. Intellectual property

  1. All content available on the Website, including text, graphics, layout and source code, as well as the content of the Quizzes and the Book, is subject to copyright owned by the Provider or third parties and is protected under the Polish Copyright and Related Rights Act.
  2. Use of the Website's content other than within the scope of permitted personal use (Article 23 of the Copyright Act) requires the prior written consent of the Provider.
  3. In particular, copying, modifying, distributing or making publicly available the content of the Quizzes and the Book without the Provider's consent is prohibited.

§ 7. User obligations

The User is obliged to:

  • use the Website in a manner consistent with law and good practice;
  • refrain from providing unlawful content (Article 8(3)(2)(b) of the Polish Act on the Provision of Electronic Services);
  • refrain from interfering with the operation of the Website, in particular by attempting unauthorised access, DoS/DDoS attacks or introducing malicious software;
  • respect the copyright and personal rights of third parties.

§ 8. Provider's liability

  1. The Provider exercises due diligence to ensure that the content of the Website is up-to-date and substantively correct, but does not guarantee its full compliance with the current state of aviation regulations.
  2. Educational content does not constitute legal, operational or medical advice and cannot replace consultation with a certified instructor, an aviation medical examiner or the competent aviation supervisory authority.
  3. The Provider is not liable for damages arising from improper use of the information contained in the Website or the Book, to the extent permitted by law. This limitation of liability does not apply to damages caused intentionally to a Consumer or in cases where exclusion of liability is inadmissible under mandatory provisions (Article 473 § 2 and Article 3851 of the Polish Civil Code).
  4. The Provider is not liable for interruptions in the operation of the Website caused by reasons beyond its control, including force majeure or failures of hosting or Internet connectivity providers.

§ 9. Complaints

  1. Complaints regarding the operation of the Website or the services provided may be submitted to: peikert@vp.pl.
  2. A complaint should include the User's identification (name, surname, email address) and a description of the issue.
  3. The Provider will respond to complaints within 14 days of receipt. Failure to respond within this period means that the complaint is considered justified (Article 7a of the Polish Consumer Rights Act — with respect to Consumers).

§ 10. Out-of-court dispute resolution (Consumers)

  1. Consumers have the option of using out-of-court complaint and redress procedures, including permanent arbitration courts at provincial trade inspectorates and county (city) consumer ombudsmen in Poland.
  2. Consumers may also use the European Commission's Online Dispute Resolution (ODR) platform available at ec.europa.eu/consumers/odr, in accordance with Regulation (EU) No 524/2013.

§ 11. Personal data

The rules for processing Users' personal data are set out in a separate document — the Privacy Policy.

§ 12. Final provisions

  1. Matters not regulated by these Terms are governed by Polish law, in particular the Polish Civil Code, the Act on the Provision of Electronic Services and — with respect to Consumers — the Consumer Rights Act.
  2. The provisions of these Terms do not exclude or limit Consumer rights arising from mandatory provisions of law. In the event of a conflict between these Terms and such provisions, the law prevails.
  3. The Provider reserves the right to amend these Terms for important reasons, in particular changes in law, in the scope of services provided, or technological changes. Changes take effect upon publication of the new version on the Website, while respecting Users' acquired rights.
  4. The court competent for disputes with non-Consumer Users is the court with jurisdiction over the Provider's place of residence. Disputes involving Consumers are heard by the court determined in accordance with the Polish Code of Civil Procedure.
